Charges At The Department of Labor Relations Regarding Anti-Union Animus

The FSU/MTA filed a charge at the Department of Labor Relations (DLR). This charge relates to allegations of anti-union animus towards the individual ('anti-union animus' refers to charges that member(s) suffered negative consequences regarding personnel decisions, discipline, etc. due to their concerted union activity).

Incorrect Rank and Incorrect Salaries Applied

The FSU filed separate grievances on behalf of 2 members who asserted that their salary is incorrect.  In the first grievance, the FSU asserted that the member was hired at the incorrect rank and hence given an incorrect salary. In the second grievance, the FSU asserted that the Administration reneged on an individual contract that would have granted the member a higher salary. In both grievances, the FSU is seeking to ensure that retroactive payment of the correct salary is paid.

Due Process Issues Related To Potential Dismissal Of NTT

An NTT faculty member with a continuing appointment was put on paid administrative leave after allegations of misconduct. The FSU expressed concern to the Administration that the administrative leave was imposed on this member without following progressive discipline. The FSU is working with this member and with Admin to ensure due process for discipline and/or dismissal is adhered to.

Summer/Winter Priority List Issues

A member who was on their department’s Summer/Winter priority list for teaching was not rehired for Fall/Spring. The Administration asserted that as a result of not being rehired for Fall/Spring, they were not obligated to give the member courses for Summer/Winter. The FSU asserted that Fall/Spring appointments and non-reappointments must be treated separately from a member’s rights under the contract to have courses assigned in Summer/Winter per the priority list.

Public Records Requests and Academic Freedom

A member received notice that a public records request had been submitted from a source outside of UMB ("Defending Education") seeking the content of UMB emails spanning several months and containing specific words to and from the member (

Tenure Denial Cases

The FSU filed two grievances on behalf of members who were denied tenure. In both cases, the FSU asserted that procedural violations had occurred in regards to faculty primary roles in academic and personnel matters. Specifically, the Provost’s decision ran counter to the recommendations at all prior levels of review. In one case, the administration agreed to redo the tenure review utilizing the proper procedures and the member was awarded tenure with the promotion being retroactive to 9/1..
